These Terms and Conditions (“Terms”) apply to all quotations, bookings, and roof restoration services provided by Diamond Cut Roof Restorations (“we”, “us”, “our”). By accepting a quotation, paying a deposit, or allowing work to commence, you (“Client”) agree to these Terms.
1. Quotations & Formation of Contract
1.1 All quotations (“Quote”) are valid for 30 days unless otherwise stated.
1.2 A binding agreement is formed when the Client accepts the Quote in writing, pays the deposit, or instructs us to proceed.
1.3 Quotes are based on visible and disclosed information. Hidden defects or conditions (rotted battens, cracked tiles, asbestos, rust, structural issues, prior coatings, pests, or water damage) may result in additional charges.
1.4 The Scope of Work is strictly limited to what appears on the Quote. Variations must be approved in writing and may affect pricing and timeframes.
2. Client Responsibilities & Site Conditions
2.1 The Client must ensure safe, unobstructed access to the property, roof, and surrounding areas during all works.
2.2 The Client must notify us of any known hazards including:
fragile roofing or skylights
electrical issues
asbestos
structural movement
inadequate drainage
2.3 The Client must provide electricity, running water, and safe site access unless otherwise agreed.
2.4 We are not liable for delays or additional costs caused by:existing damage or deterioration
poor roof design or installation
improper drainage or ponding
rust, structural faults, or tile brittleness
debris, vermin damage, or hidden issues
2.5 The Client must move vehicles, outdoor furniture, and belongings to prevent overspray, runoff, or accidental damage.
3. Performance of Roof Restoration Services
3.1 We perform all services with due care, skill, and in accordance with Western Australian roofing standards.
3.2 Roof restoration may include cleaning, repairs, repointing, sealing, priming, painting, rust treatment, tile replacement, or general restoration as specified in the Quote.
3.3 All timeframes are estimates and may vary due to weather, curing time, safety considerations, or product requirements.
3.4 Due to age variation, porosity, and previous coatings, exact colour matching cannot be guaranteed for repaired or replaced roof areas.
4. Weather, Safety & Worksite Control
4.1 We may delay or reschedule works if conditions are unsafe or unsuitable, including rain, extreme heat, excessive winds, or poor curing weather.
4.2 Once works commence, the Client must not enter the work area or roof without consent.
4.3 The Client must not allow other trades or persons on the roof or immediate work area until the project is fully completed.
4.4 We take all reasonable precautions to minimise overspray; however, the Client accepts a small risk of overspray or water runoff due to roof height, pitch, or wind conditions.
5. Post-Completion Conditions
5.1 After completion, the Client must allow coatings or materials to cure fully. During curing, the Client must not:
walk on the roof
allow other trades onto the roof
run sprinklers, hoses, or introduce moisture
touch or interfere with coatings
obstruct drainage
5.2 Damage from weather, impact, animals, third parties, or misuse after completion is not covered under warranty.
5.3 The Client must maintain gutters, downpipes, and the roof structure to ensure proper drainage and prevent water-related issues.
6. Risks of Non-Compliance
Failure to follow these Terms may result in:
coating failure, peeling, or blistering
tile breakage or structural damage
leaks or moisture penetration
contamination of fresh coatings
overspray damage to items not removed
voided warranties
additional costs for rework or repairs
All repairs due to Client non-compliance will be charged at the Client’s expense.
7. Warranty
7.1 Diamond Cut Roof Restorations provides a 10-year workmanship warranty from the date of completion.
7.2 This warranty covers:
peeling or adhesion failure of coatings applied by us
workmanship-related defects
7.3 This warranty does not cover:leaks caused by structural faults, broken tiles, poor roof design, or drainage issues
damage from storms, hail, falling objects, debris, or animals
normal weathering, fading, colour variation, or oxidation
rust reappearing on severely aged metal roofing
tile breakage due to age or fragility
damage caused by other trades or unauthorised roof access
prior coatings, substrate failure, or hidden defects
7.4 Warranty claims must be made in writing and include proof of purchase and photographic evidence.
7.5 Failure to comply with pre-work, during-work, or post-completion requirements may void the warranty to the extent permitted by law.
7.6 This warranty is in addition to the Client’s rights under the Australian Consumer Law (ACL).
8. Liability & ACL Compliance
8.1 Nothing in these Terms excludes any rights under the ACL that cannot be excluded.
8.2 To the maximum extent permitted by law, we exclude liability for all indirect or consequential loss including:
loss of value
staining or overspray
delays
water runoff
cosmetic imperfections
8.3 Where liability cannot be excluded, our liability is limited (at our discretion) to:re-supplying the services; or
paying the cost of re-supplying the services.
8.4 We are not liable for damage caused by:pre-existing roof conditions
structural movement
unauthorised access
weather conditions
third-party trades
client negligence or misuse
hidden defects or aged materials
8.5 The Client indemnifies Diamond Cut Roof Restorations for losses caused by the Client’s breach of these Terms.
9. Subcontractors
9.1 Diamond Cut Roof Restorations may recommend subcontractors. These subcontractors are independent, hold their own insurance, and are not our employees.
9.2 We are not responsible for subcontractors engaged directly by the Client.
9.3 If we engage subcontractors as part of the quoted works, we remain responsible only for work performed under our direct control.
10. Payment Terms
10.1 A deposit (as specified in the Quote) is required to secure the booking.
10.2 Final payment is due upon completion unless agreed otherwise in writing.
10.3 Late payments may incur interest and debt recovery expenses.
10.4 Deposits may be forfeited if the Client cancels after materials are purchased or work has commenced.
11. Cancellations & Rescheduling
11.1 Cancellations within 14 days of the scheduled start date may result in deposit forfeiture.
11.2 Rescheduling is subject to weather and availability.
11.3 Delays caused by the Client (e.g., unsafe access, obstructions, unavailable utilities) may incur additional fees.
12. Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including extreme weather, supplier shortages, illness, or labour disruptions.
13. Governing Law
These Terms are governed by the laws of Western Australia. Any disputes will be handled in the courts of Western Australia.
Acknowledgement
By booking with Diamond Cut Roof Restorations, the Client confirms they have read, understood, and agree to be bound by these Terms & Conditions.
